Terms and Conditions for Members

1. Introductory Provisions and Definitions

Member: A user who purchases a membership on the Creatsub platform, buys individual paid content, or provides a creator with a voluntary financial contribution.

Operator: Creatsub s.r.o., 28. října 810/246, Mariánské Hory, 709 00 Ostrava, Czech Republic, Company ID: 21726370.

Platform: The online Creatsub platform available through the web interface and related services.

Creator: A user who publishes content on the platform and makes it available to members for payment or voluntary support.

Membership Fee: A recurring payment for access to content or benefits within the scope of the selected membership.

Creatsub is a technology platform that enables creators to publish content and members to support or access that content. The Operator is not the author or owner of content published by creators unless expressly stated otherwise.

2. Rights and Obligations of the Contracting Parties

Operator: Ensures operation of the platform, technical access to content, payment processing, and communication related to the use of the service. The Operator may reasonably modify platform features provided that the substance of an already paid service is not affected.

Member: Has the right to access purchased content to the extent corresponding to the paid membership or one-time payment. The Member is obliged to provide truthful information, protect their access credentials, and use the platform in accordance with these terms and applicable laws.

The Member must not give third parties access to their account. If misuse is detected, the account may be temporarily suspended or terminated. In such a case, the user's access to the service may be restricted without entitlement to a refund of amounts already paid.

The Member is responsible for activities performed under their account until they demonstrably notify the Operator of suspected account misuse.

3. Payments and Membership

Membership Fee

The membership fee is a recurring payment that is normally charged automatically every month unless otherwise stated for a specific offer. Membership provides the member with access to premium content within the scope of the selected tier for a specific creator.

The Member may cancel membership at any time:

The Creator may change the membership price for the future. If the price changes, existing members keep their original price until they cancel or interrupt the membership themselves, unless otherwise stated for a specific offer.

Purchase of Paid Content

The user may purchase individual posts or other paid content marked by the creator as paid. After successful payment, the content will be made available within the user account. By purchasing the content, the member does not acquire any ownership or licensing rights to the work, except for the right to personal use within the scope enabled by the platform.

Availability of purchased content may be limited in time according to the creator’s settings or may end if the content is removed from the platform for legal, technical, or contractual reasons.

Digital Content and Withdrawal from the Contract

The member acknowledges that when purchasing digital content or membership, performance may be provided immediately after payment. By giving explicit consent to access digital content before the withdrawal period expires, the member agrees to the commencement of performance and acknowledges that they thereby lose the right to withdraw from the contract within the statutory period, where permitted by applicable law.

Refunds and Complaints Regarding Digital Content

Once digital content has been properly made available or membership has been activated, there is generally no entitlement to a refund merely because of a change of mind or non-use of the service. This does not affect the member’s rights arising from defective performance or their statutory consumer rights.

A request for a refund or reasonable compensation may be justified in particular if:

Each request will be assessed individually with regard to the circumstances of the case, the technical state of the service, and applicable legal regulations.

Voluntary Financial Contribution

Users may support creators with a voluntary financial contribution in any amount. The contribution is voluntary and by itself does not create entitlement to paid content or other benefits unless the creator expressly states otherwise.

Irrevocability of the Contribution: After a successful contribution has been sent, the amount is generally not refunded unless there is a legal reason, a technical error, an obvious duplicate payment, or the Operator or creator decides otherwise.

Legal Nature of the Contribution: By making a contribution, the contributor does not acquire any ownership or other rights to the creator’s content or to the platform’s services beyond any expressly promised performance.

4. Privacy Protection

Information on the processing of personal data, its scope, purposes, and user rights is set out in the separate section Creatsub Privacy Policy.

5. Changes to the Terms and Conditions

The Operator may reasonably amend or supplement these Terms and Conditions, especially if legal regulations, platform features, or the method of providing the service change.

The member will be informed of material changes by email or by notice on the platform at least 14 days before they take effect. If the member does not agree with the changes, they may stop using the service and cancel their membership before the effective date without penalty for future periods.

6. Liability and Complaints

The Operator is responsible for the proper functioning of the platform to a reasonable extent corresponding to the nature of an online service. The Operator is not responsible for temporary unavailability caused by circumstances beyond its reasonable control, in particular third-party outages, attacks on infrastructure, or force majeure.

The Operator is not responsible for content published by creators. The creator who published the content is responsible for the legality, truthfulness, quality, and compliance of the content with legal regulations.

Complaints concerning payments, service availability, or defects in digital content may be submitted via the contact email info@creatsub.io without undue delay after discovering the issue.

The Operator reserves the right to use reasonable tools to detect unlawful or otherwise prohibited content, including review by administrators. Such content may be removed, blocked, or made available only in a limited manner. In the event of repeated or serious breaches of the rules, the account may be restricted or terminated.

Terms and Conditions for Creators

1. Introductory Provisions and Definitions

Creator: A user who creates and publishes content on the Creatsub platform.

Operator: Creatsub s.r.o., 28. října 810/246, Mariánské Hory, 709 00 Ostrava, Czech Republic, Company ID: 21726370.

Platform: The online Creatsub platform that enables the publication and monetization of content through memberships, one-time payments, and other features currently offered by the platform.

Member: A user who purchases a membership, buys paid content, or supports a creator through the platform.

Creatsub is a technology platform. The Operator is not the author of the creator’s content and does not acquire ownership rights to it, except for the limited authorization necessary for the operation of the platform.

2. Rights and Obligations of the Contracting Parties

Operator: Ensures operation of the platform, technical access to content, payment administration, basic technical support, and may remove or restrict content that is in conflict with legal regulations or these Terms.

Creator: Is responsible for the content they publish, for the truthfulness of the information provided during registration, and for ensuring that their activity on the platform complies with legal regulations, copyright law, and third-party rights.

The creator must not publish content that is unlawful, infringes third-party rights, incites hatred or violence, contains prohibited manipulation, fraudulent conduct, or is otherwise contrary to the platform rules. The platform is not intended for publishing pornographic or explicitly sexual content.

3. Creator Status

The creator is obliged to provide truthful, complete, and up-to-date information during registration. The Operator reserves the right to approve or reject registration, or subsequently restrict or terminate the account if the creator breaches these Terms or legal regulations.

The creator is obliged to continuously update their identification, contact, and payment details and is responsible for ensuring that the data required for payouts is accurate.

4. Content License

The creator remains the owner of the rights to their content to the extent such rights belong to them.

The creator grants the Operator a non-exclusive, territorially unlimited, and for the duration of publication valid license to use the content to the extent necessary for operating the platform, in particular for storing, technically processing, displaying, making it available to members, and promoting the creator’s profile within the platform.

This license is granted free of charge because it forms part of the service that the platform provides to the creator.

5. Creator Payouts

Financial proceeds are usually paid to creators by the 16th day of the following month for the previous calendar month unless otherwise stated for a specific service or payout regime.

The Operator’s fee according to the current fee schedule and any other direct costs connected with the transfer of funds, where applicable, will be deducted from the payout.

Payouts are sent to the bank account specified by the creator. If the creator specifies an account outside the EU or the payout requires a special banking regime, a corresponding fee for an international or non-standard transfer may be charged.

6. Operator Fees

The Operator is entitled to remuneration for providing the platform, its operation, technical support, development, maintenance, updates, and payment processing.

The commission rate is based on the creator’s turnover on the Creatsub platform within the scope set by the current tariff.

We believe in fairness. The more creators earn on the platform, the more advantageous tariff conditions they may receive.

Fee Schedule

Fees for gifted memberships, store sales, and other monetization methods are charged according to the applicable tariff unless otherwise stated for a specific service.

For membership purposes, the tariff level is calculated from membership fees unless the Operator expressly specifies another calculation method.

7. Creator Tax Obligations

Creators are responsible for fulfilling their tax, accounting, and record-keeping obligations under the legal regulations applicable to them. This includes, in particular, proper reporting of income, possible VAT obligations, and other statutory levies.

8. Responsibility for Content and Its Management

The creator is obliged to ensure that their content does not violate laws, copyright, personality rights, trademark rights, or any other third-party rights.

The creator is responsible for damage caused to the Operator or third parties by breach of these obligations.

Prohibited or legally problematic content may be removed or restricted without prior notice. In the event of serious or repeated breaches of the rules, the creator’s account may be suspended or terminated.

9. Out-of-Court Dispute Resolution

In the event of a dispute between a user and the Operator, the parties shall first attempt an amicable resolution. The user may contact the Operator at the email address info@creatsub.io.

If the user is a consumer, they may also contact the out-of-court consumer dispute resolution body in the Czech Republic, which is the Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, website www.coi.gov.cz.

10. Other Provisions

Communication between the Operator and users takes place primarily via email or notices within the platform.

Legal relationships arising in connection with the use of the platform are governed by the laws of the Czech Republic.

The Operator may reasonably amend these Terms. Creators will be informed in advance of material changes by email or notice on the platform.

Creatsub Privacy Policy

1. Introductory Provisions

For the operation of the Creatsub platform, we process certain personal data of users. This policy briefly explains what data we process, why we need it, and what rights you have.

2. Data Controller

3. What Data We Process and Why

Inquiries and Communication: Data from the contact form, email, or chatbot is processed for the purpose of handling your inquiry and subsequent communication.

Registration and User Account: Data necessary for the creation and administration of an account is processed for the duration of the user relationship and thereafter for the time necessary to protect legal claims and fulfill legal obligations.

Payments: Data necessary for payment processing, accounting, and transaction records is processed to the extent required for performance of the contract and fulfillment of legal obligations.

Emailing: If you subscribe to updates or if sending them is permitted on the basis of a legal ground under applicable regulations, we may use your email address to send newsletters and operational messages. You may unsubscribe at any time.

Recurring Payments: We do not store complete payment card details. These details are processed by the payment gateway provider under its own terms and privacy policy.

4. Data Retention Period

We retain personal data only for the period necessary to fulfill the purpose of processing, perform the contract, comply with legal obligations, or protect our legitimate interests.

Data related to accounting, tax documents, and payments is retained for the period required by legal regulations. User account data may be retained for a limited period after account deletion for the purpose of account recovery, dispute resolution, abuse prevention, and legal compliance.

5. Who May Access the Data

Personal data may be accessed by our contractual partners and processors where necessary for operation of the platform, such as providers of hosting, technical infrastructure, payment services, accounting, or communication tools.

In some cases, creators may be independent controllers of their members’ personal data to the extent necessary for providing their content, fulfilling their own legal obligations, or maintaining their own accounting records.

6. User Rights Under GDPR

You have the right to request access to your personal data, correction, deletion, restriction of processing, data portability, and the right to object to processing in cases provided by legal regulations.

You also have the right to lodge a complaint with the Data Protection Authority.

7. Connections with Third Parties

If you connect your Creatsub account with third-party accounts, such as Google, Apple, or Facebook, the processing of personal data by those services is governed by their own policies.

Cookie Policy

1. Introductory Provisions

On the Creatsub platform, we use cookies and similar technical tools primarily to ensure proper website operation, security, and improvement of the user experience. We approach privacy with an emphasis on data minimization and do not use third-party advertising tracking systems.

2. What Cookies Are

Cookies are small text files stored on your device or browser. They help ensure website functionality, secure login, remembering certain choices, and anonymous traffic evaluation.

3. Types of Cookies

We do not use marketing cookies or cookies for profiling users by third parties.

4. How We Use Cookies

Technical, functional, and security cookies are used to the extent necessary for operation of the website and service security.

Analytical and preference cookies are used only to the extent permitted by applicable legal regulations. Where required, we process them only on the basis of your consent.

5. Analytics and Third Parties

We do not use advertising or tracking tools of third parties such as Google Ads or similar systems. If we use analytics tools, we aim to operate them in the most anonymized mode possible and under our control.

6. How to Limit Cookies

You may delete or block cookies at any time in your browser settings. However, please note that blocking certain technical or security cookies may limit the functionality of the platform.

7. User Rights

In connection with cookies and personal data processing, you have the rights described in the Creatsub Privacy Policy.

Language Versions of the Document

These Terms and Conditions, Privacy Policy, and other legal documents of the Creatsub platform may also be made available in other language versions for the purpose of improving user understanding.

In the event of any discrepancy between the individual language versions, the Czech version shall prevail.
